Acceptable Use Policy

This Acceptable Use Policy (“AUP”) governs use of Earnesty, the platform operated by Know Reply Inc. (“Know Reply”, “we”, “us”), including our marketing site at earnesty.app, the application at go.earnesty.app, the status pages at earnesty.page, and our APIs (collectively, the “Service”). It binds two different audiences: the software products that run an earned tier on Earnesty (“APPs”), and the end users of those products who earn a reward by posting (“USERs”). Section 3 applies to everyone. Section 4 applies to APPs. Section 5 applies to USERs. This AUP is part of the Earnesty Terms of Service for APPs and part of the Participation Agreement for USERs.
1. Words We Use
- APP — a software product that runs an earned tier using Earnesty, together with everyone who acts on its behalf: its organization members, agencies, contractors, and anyone using its API keys.
- the Product — the APP’s software product as a USER experiences it. Where this policy speaks to USERs, “the Product” is the app you are enrolled in and posting about.
- USER — an end user of an APP who is enrolled in that APP’s earned tier and earns the APP’s Rewards by posting publicly.
- Claim Code — the short permanent per-USER string (for example,
#earnesty_7K4PXM) that a USER includes in a post. - Partner Tag — the disclosure hashtag, of the form
#{Brand}_Partner(for example,#Acme_Partner), required in a Qualifying Post, and asked to sit near the start. - Qualifying Post — a public post on a Supported Platform that passes Verification and earns a reward.
- Verification — our mechanical checks on a post. Verification looks at whether a post is public, whether its author is bound to the USER, whether the APP’s @mention and the Partner Tag are present, and whether the post has been credited before. It never reads sentiment.
- Supported Platform — a social platform Earnesty supports, as listed in the Supported Platforms schedule.
- Reward — whatever an APP grants its USER for a Qualifying Post, in the APP’s own product. Rewards take whatever form the APP chooses — usage credits, model tokens, seats or licences, entry to a Drop, a bonus month — and an APP may offer more than one form. Earnesty never issues, holds, or transfers a Reward; we verify the post and relay the instruction, and a Reward has no cash value.
- Credits — the most common form of Reward, and the one most of our examples use: an APP’s own in-product usage currency. “Credits” is an example of a Reward, never a limit on what a Reward may be.
2. The Short Version
Earnesty rewards a disclosed act of posting. It does not buy sentiment, reach, followers, likes, or reviews, and it does not let anyone else use it to buy them either. Almost every rule below is a consequence of that one sentence.
3. Rules for Everyone
These rules apply to APPs and USERs alike.
Illegal activity
- Do not use the Service for any unlawful purpose, or to facilitate fraud, phishing, money laundering, or identity theft.
- Do not use the Service in connection with the sale or promotion of illegal goods or services.
- Do not process or transmit content that violates applicable law, including advertising, consumer-protection, securities, and sanctions law.
Intellectual property
- Do not post, submit, or transmit content that infringes anyone’s copyright, trademark, or other rights.
- Do not use another party’s brand, logo, or name in a way that suggests a partnership that does not exist.
- Do not impersonate another person, product, or organization anywhere in the Service or in a post that runs through it.
Harassment and harmful content
- Do not use the Service to produce or distribute threatening, harassing, abusive, defamatory, or discriminatory content.
- Do not use it to promote violence or hatred against individuals or groups, or to target a private individual.
- Do not use it to distribute sexual content involving minors, or any content that sexualizes minors, in any form.
Malware and security
- Do not distribute malware, viruses, or other malicious code through the Service.
- Do not attempt to gain unauthorized access to the Service, to another organization’s account, to another USER’s Claim or Claim Code, or to our systems.
- Do not probe or test the security of the Service without our written permission. If you find a vulnerability, report it to us and give us a reasonable chance to fix it before disclosing it.
Interference with the Service
- Do not conduct denial-of-service attacks or otherwise disrupt or degrade the Service for others.
- Do not overload, flood, or knowingly send malformed traffic to our APIs or webhooks.
- Do not interfere with Verification, with reward delivery to any USER, or with any other party’s ability to use the Service.
Rate limits and Verification
- Do not circumvent, or attempt to circumvent, rate limits, plan capacity limits, cooldown windows, or the “check now” allowance.
- Do not attempt to defeat Verification. This includes editing a post after it has been checked so that it no longer carries the required elements, deleting and reposting to reset a window, using multiple accounts or identities to claim the same reward more than once, and using bots, purchased accounts, or coordinated networks to manufacture posts or engagement.
- Do not create accounts, enrollments, or platform bindings for anyone other than the real person or organization they represent.
Scraping and reverse engineering
- Do not scrape or crawl the Service, or use automated tools to extract data from it beyond the documented API and normal product use.
- Do not harvest USER identifiers, handles, Claim Codes, or post records from status pages or any other surface.
- Do not reverse engineer, decompile, or disassemble the Service, or attempt to derive our Verification logic, fraud detection, or models.
- Do not use the Service or its output to build a competing product.
4. Rules for APPs
These rules apply in addition to Section 3. They exist because the APP is the advertiser of record — Know Reply is a technology provider that verifies posts and relays reward instructions. What an APP asks USERs to do is the APP’s own advertising, and the law treats it that way.
Run only a product you own
- Do not run an earned tier for a product you do not own or control, unless you are acting as an authorized agent for its owner and can show it on request.
- Make sure your own terms of service permit you to operate an earned tier with your users. That is your responsibility, not ours.
Never condition rewards on sentiment or outcomes
- Do not condition a reward, a reward amount, a Drop eligibility, or continued enrollment on a post being positive, favorable, or free of criticism. A critical post earns exactly what a positive post earns.
- Do not condition a reward on any outcome — a signup, an install, a conversion, a click, a sale, a follower count, or any engagement threshold.
- Do not offer, off-platform, anything of value that reintroduces either condition. Doing it outside Earnesty does not make it acceptable inside Earnesty.
Never direct the content of a post
- Do not write, script, dictate, or supply the text of a USER’s post. Suggested topics and factual talking points are fine; a required script is not.
- Do not require a USER to submit a post for approval before publishing, or condition a reward on your approval of what it says.
- Do not ask a USER to state something they do not believe or have not experienced, or to describe an experience they have not had.
Never suppress the Partner Tag
- Do not instruct, encourage, or permit a USER to omit, bury, obscure, or misspell the Partner Tag, and do not tell a USER that a post “works better” without it.
- Do not discourage the use of a Supported Platform’s own paid-partnership label.
- Do not offer any alternative path to a reward that skips disclosure.
Reviews and third-party platforms
- Do not use Earnesty to incentivize reviews, ratings, or testimonials on third-party review platforms — app stores, marketplaces, or review sites. Earnesty rewards public social posts on Supported Platforms only.
- Earnesty does not integrate with review platforms and will not operate a review program of its own. This is a deliberate product boundary, not a temporary gap: incentivized reviews on review platforms sit squarely in the conduct 16 CFR 465 was written to address, and we stay out of that business entirely.
- This rule governs what you route through the Service. What you do entirely outside Earnesty is between you and your own counsel — but a reward that reaches a USER through Earnesty must be for a Qualifying Post on a Supported Platform, and nothing else.
Restricted and prohibited verticals
- The following require our prior written approval before you may run an earned tier: adult content; gambling, betting, and real-money gaming; financial, investment, tax, or legal advice; credit repair, debt relief, and lending; health, medical, supplement, or wellness products making health claims; alcohol, tobacco, nicotine, and cannabis; firearms; cryptocurrency and digital-asset offerings; and multi-level marketing. Ask us at hello@earnesty.app before you launch.
- Do not run an earned tier for a product directed to children, and do not knowingly enroll a USER under 18 years of age. Participation means accepting compensation for a public endorsement, so the floor is 18 everywhere in Earnesty — not the lower age that would suffice for privacy purposes alone.
No engagement-for-engagement
- Do not use the Service to acquire posts, attention, or engagement for a product that is itself an engagement, follower, review, or amplification service. Earnesty is not available to the engagement-for-sale industry, in either direction.
Your organization’s people
- You are responsible for everything done under your organization’s account and API keys, including by your employees, agencies, and contractors.
5. Rules for USERs
These rules apply in addition to Section 3. The full ladder of prohibited conduct — and the consequences at each rung — lives in the Earned Tier Program Rules, which are part of your Participation Agreement. Read them; they govern. In summary, and without repeating them:
- Post in your own words, about your own experience. Do not copy someone else’s post, run a generated post you have not read and do not stand behind, or describe an experience you have not had.
- Keep the Partner Tag in the post. Anywhere in it counts. Do not omit it, hide it, break it, or remove it after your post has been checked. If a Product asks you to drop it, that Product is breaking this policy — please tell us.
- One person, one identity. Do not enroll more than once for the same Product, share or sell your Claim Code, use someone else’s account, or coordinate with others to earn the same reward more than once.
- Do not manufacture engagement. The reply bonus counts distinct real accounts that replied. Bought, botted, or traded engagement is not that, and replying to yourself is not conversation.
- Do not game the timing. Deleting, re-posting, or editing a post to reset a window or claim a reward twice is a violation, not a strategy.
- Say it if you are an insider. If you work for the Product’s company — or you’re a contractor, investor, or an immediate family member of someone who is — say so in the post itself, near the start. “I work at Acme” is enough. The Partner Tag says you were rewarded; it doesn’t say you’re an insider.
- What you earn is not money. Credits, tokens, seats, a free month — whatever your Product grants you has no cash value, is not redeemable for money, and is not transferable between USERs. Do not offer to sell or trade it.
Say whatever you want about the product. Nothing in this section limits your opinion. Criticism earns the same reward as praise, and always will.
6. Supported Platform Rules Always Apply
Every post that runs through Earnesty is also governed by the rules of the platform it is posted on. You must comply with the Supported Platform’s own terms of service, developer agreement, and advertising, disclosure, automation, and platform-manipulation policies.
Nothing in this AUP, in the Program Rules, or in anything an APP tells a USER licenses a violation of a platform’s policies. Where a platform’s rules are stricter than ours, the platform’s rules win. Where a platform requires or offers a paid-partnership label, use it — we encourage it on every Qualifying Post, though Verification never depends on it. If a platform suspends, restricts, or removes content or an account, that is the platform’s decision and we cannot reverse it.
7. Automated Abuse Prevention
We run automated systems that look for abuse: unusual enrollment or claim volumes, duplicate or near-duplicate posts, coordinated posting networks, repeated Verification failures of the same kind, and attempts to bypass limits or security controls. These systems look at patterns and mechanics — never at whether a post is favorable.
If our systems flag an account, an organization, or an enrollment, we may restrict access temporarily while we review the activity. We will notify the affected party promptly when we take action.
8. Reporting Abuse
If you see misuse of the Service — an APP pressuring USERs to drop the Partner Tag, an APP conditioning rewards on sentiment, coordinated fake posting, or anything else in this AUP — report it to abuse@earnesty.app. Include as much detail as you can: the Product involved, links to the posts, dates, and any screenshots. We investigate every report.
You may report anonymously, and we do not tell the reported party who reported them. We will not retaliate against a USER for a good-faith report, and we will not pass a reporter’s identity to the APP they reported. If a report cannot be investigated without revealing who made it, we will say so and ask before going further.
9. Enforcement
If we determine that this AUP has been violated, we may take one or more of the following steps, in proportion to what happened:
- Warning — we may write to you and ask you to stop.
- Verification hold — we may pause Verification or reward delivery for a specific Claim, enrollment, or campaign while we look at it. A hold is an integrity control and nothing else. It is never a billing control and never an editorial one: we do not hold Verification over an unpaid invoice, a plan, a balance, or anything a post said. Verification and delivery are never gated by billing state or plan; only speed and on-demand depth are priced. A hold ends when the review does, and a Claim released from hold is still valued at the post’s timestamp against the terms snapshot in force when it was issued.
- Feature restriction — we may restrict access to specific features, lower rate limits, or suspend Drops.
- Suspension — we may suspend an APP’s organization account or a USER’s enrollment while we investigate or until the violation is corrected.
- Termination — we may permanently terminate an APP’s account or a USER’s enrollment for serious or repeated violations.
- Legal action and referral — we may pursue legal remedies and report illegal activity to law enforcement.
We never enforce this policy based on the opinions expressed in a post. Earnesty does not read, score, or reward sentiment, and no action under this section will ever be taken because a post was critical, unflattering, or unenthusiastic about a product. Enforcement responds to conduct — deception, disclosure failures, manipulation, fraud, illegality, and abuse of the Service — and nothing else. If an APP asks us to act against a USER because of what a post said, we will decline, and the request itself is a violation of Section 4.
Two commitments survive enforcement against an APP, because they are promises already made to people who did nothing wrong: a Claim already issued is still evaluated and settled against the terms snapshot in force when it was issued, and an already-enrolled USER is not invalidated by an action taken against their Product. Suspension closes the faucet for new Claims; it does not unwind promises already made. See the Earnesty Terms of Service for how wind-down works.
Accounts terminated for a violation are not eligible for refunds. See the Refund Policy.
10. Changes to This Policy
We may update this AUP from time to time — new Supported Platforms, new abuse patterns, and changes in the law all tend to require it. We will communicate material changes on our website and by email. Continued use of the Service after a change takes effect means you accept the revised policy.
